In the following we would like to inform you of the circumstances in which we collect data from you and how we handle it.

2. Personal data

Personal data refers to any information concerning the personal or material circumstances of an identified or identifiable natural person. This includes information such as IP address, your real name, address, telephone number and date of birth. Information not directly linked to your actual identity –such as favorited websites or the number of users of a site – are not personal data.

3. Processing personal data

Our website does not require you to register in order to use it, and we do not find out any personal data such as your name, address, telephone number or e-mail address, unless you provide them voluntarily (e.g. by using the contact form). However, your visit to our website is recorded. This involves capturing the current IP address of your computer in anonymised form, the selected websites, your browser type, the date, time and duration of your visit, and your computer’s operating system.

4. Specific use and sharing of personal data

DEVnet GmbH uses the personal data you provide, only to the extent needed, for technical administration of the website, services, administration of customers and prospective customers, product-related surveys and marketing.

Collected data is only shared with third parties in connection with the use of web analysis tools (see notes on Matomo (formerly Piwik)), unless sharing data is required by court order or other legal or supervisory law regulations. Otherwise, your personal data is only shared with third parties if necessary for contractual performance or if you have given your express consent. If we commission external service providers, these are carefully selected and obligated, in accordance with Art. 28 GDPR, to comply with all provisions under data protection law.

5. Legal basis for data processing

The legal basis for processing your personal data depends on the underlying purpose of the data processing.

Technical administration of the website

The legal basis of processing personal data for the above purpose is Art. 6 (1) b) GDPR, provided we have a contractual relationship with you. If you do not have a contractual relationship with DEVnet GmbH, the legal basis for data processing is Art. 6 (1) f) GDPR. Transfer of personal data (such as the IP address) is necessary to connect to and display the content of the website.

Services

The legal basis of processing personal data for the above purpose is Art. 6 (1) b) GDPR. We provide services within the scope of fulfilling contractual obligations. If we do not process personal data, we cannot meet our contractual obligations/perform the contract.

Matomo (formerly Piwik)

The legal basis for processing personal data in the context of using Matomo is Art. 6 (1) f) GDPR. We need statistical information about the use of our website in order to make it more user-friendly, measure its reach and conduct market research.

Use of cookies

The legal basis for processing personal data when saving and reading cookies is for the purposes of our legitimate interests in personalised design of our website/online services pursuant to Art. 6 (1) f) GDPR.

Use of the contact form

The legal basis of processing personal data for the above purpose is Art. 6 (1) b) GDPR or Art. 6 (1) a) GDPR. We process your personal data in order to process your enquiries and/or applications for employment. If we do not process personal data, we cannot respond to your enquiries or applications.

Use of cookies and web analysis tools

We use cookies the web analysis tool Matomo (formerly Piwik) to record visits to our website. The data collected is used for marketing purposes and to optimise website usability, and for no other reasons.

Use of cookies

Our website uses cookies. These are small text files that enable the user's device to save specific information relating to the user during the website visit. Cookies enable us to determine in particular the frequency of use and number of users, to analyse how users use the site, and also to make our website more user-friendly. Cookies are saved after you end a browser session and can be reactivated when you return to a website. If you do not wish cookies to be saved, you can change your Internet browser settings to reject cookies.

Use of Matomo (formerly Piwik)

Matomo (formerly Piwik) uses our website to provide a web analysis service. Matomo uses cookies, which are text files stored on your computer that enable us to analyse use of our website. The usage information generated by the cookie for this purpose (including your abbreviated IP address) is transmitted to our server and stored for usage analysis, which helps us to optimise our website. Your IP address is immediately anonymised in this process, so you as user remain anonymous to us.

When you access individual pages of our website, the following data is stored: the accessed webpage, the website from which a link was followed (referrer), the subpages visited via the accessed website, the duration of the visit to the website and the frequency of visits. The IP address is anonymised before being saved in this process.

The software used runs on our website’s servers only. Personal data of users is only stored there. We will not share the information generated by the cookie about your use of this website with third parties. You can prevent cookies from being used by changing your browser software settings accordingly. However, if you do so, you may not be able to make full use of all the functions of this website.

The data is deleted when it is no longer needed for logging purposes.

This is after six months in our case. If you do not consent to the data from your visit being stored and evaluated, you can object to storage and use at any time by clicking on this checkbox.

6. Using the contact form

We use the personal data you transmit to process enquiries and job applications. Of course, we treat the data you provide confidentially, and only share it with affiliated companies or companies commissioned with data processing to the extent this is permissible within the scope of the purposes described and legal provisions. If we commission processors, these are carefully selected and obligated, in accordance with Art. 28 GDPR, to comply with all provisions under data protection law. If a processor is not based in the European Union, we will observe the provisions of Art. 44 et seq. GDPR, e.g. concluding standard contractual clauses with the processor.

The e-mail function on our website uses a protected Internet connection. DEVnet assumes no liability or responsibility regarding the confidentiality or completeness of data transfers.

We only store your personal data for as long as necessary to make a decision about your application. If it results in your employment with us, the statutory deadlines for data retention apply. If we decide not to employ you, your data will be deleted six months after we reject your application.

Contact data provided outside of the application process is deleted after processing unless it results in a business relationship or we have your written consent to keep it.

7. Data security

Our staff and contracted service providers are obligated to maintain confidentiality and observe the provisions of applicable data protection law. DEVnet GmbH takes appropriate technical and organisational security measures to protect your personal data from loss, alteration, destruction and unauthorised access or disclosure. Our security measures are continually improved in line with technological developments.

8. Duration of data storage

We store your data for as long as necessary to provide our online offering and the associated services, or we have a legitimate interest in continued storage (e.g. we may still have a legitimate interest in postal marketing after a contract has been performed). Data is deleted upon expiry of the statutory or contractual retention periods (e.g. tax and commercial law retention periods). Data not subject to retention obligations is deleted after the intended purpose ceases to apply.

9. User rights

You have various rights as a user of our website. You can use the information in the contact section to exercise your rights. Please ensure that we can clearly identify you.

10. Rights of access, to rectification and to erasure of data

In accordance with the General Data Protection Regulation, you have the right to obtain at any time, upon request and free of charge, written information about which data concerning you has been stored (e.g. name and address). You are further entitled to rectification or erasure of this data provided that the legal requirements are met. You do not have the right to demand erasure of data stored relating to business processes, for example, as this is subject to a statutory retention obligation.

11. Right to restriction of processing

You have the right to obtain restriction of processing of your personal data.

12. Right to object

You are also entitled to object, at any time, to our processing of your data. We will then stop processing your personal data, unless we can demonstrate in accordance with statutory provisions compelling legitimate grounds for continuing to process it which override your rights.

13. Right to data portability

We will also give you the personal data you have provided, upon request, in a commonly used and machine-readable format.

14. Withdrawal of consent

You have the right, at any time, to withdraw the consent you granted us to processing of your personal data for one or more reasons, with effect for the future. The lawfulness of the processing of your personal data before withdrawal of consent is not affected.

15. Obligation to provide personal data

If a contract is concluded between you and DEVnet GmbH, you must provide the personal data necessary to initiate, perform and terminate the contractual relationship and meet the associated contractual obligations, or which we are legally required to collect. If you do not provide this data, we will not usually be able to conclude a contract with you, perform it or terminate it.

Where data processing is not necessary for the initiation, performance or termination of a contractual relationship or to meet contractual obligations, and is not legally required, your provision of personal data is voluntary. Please note that certain functions of the website and services cannot be used if you do not provide the data needed for the purpose.

16. Automatic processing of personal data

Your personal data is processed exclusively automatically only if necessary for the initiation or performance of a contract, and provided that it does not have legal or similar implications for you.

17. Complaints to supervisory authorities

You have the right to contact the competent supervisory authority if you have complaints regarding the processing of your persona data. You can approach either the data protection authority responsible for the city or federal state where you live, or the data protection authority responsible for us: Bayerisches Landesamt für Datenschutzaufsicht (BayLDA), Promenade 27, 91522 Ansbach, Germany.

Information on your right to object pursuant to Art. 21 GDPR

1. Right to object in an individual case

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6 (1) e) (data processing in the public interest) or f) (data processing for the purposes of legitimate interests) GDPR, including profiling based on those provisions.

If you object, we will no longer process your personal data, unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

2. Right to object to data processing for direct marketing purposes

In individual cases, we process your personal data for direct marketing purposes. You have the right to object to such processing, which includes profiling to the extent that it is related to such direct marketing. If you object to processing for direct marketing purposes, your personal data shall no longer be processed for such purposes.
